PEMCAS needs to gather and use certain information about individuals. These may include customers, suppliers, business contacts, employees, and other people the organisation has relationships with or may need to contact.

As a company promoting privacy awareness and compliance, we at PEMCAS have created a Privacy Policy that aims to help you understand what data we, as a Data Controller, collect, what we use it for and how you can exercise your rights.

We collect personal data to offer and administer our services in accordance with this policy and with data protection law.

PEMCAS uses the Personal Data you provide:

  • To provide you with the information and services you request from us;

  • To fulfil our obligations to you, such as processing the payment (if you enter into a contract with PEMCAS);

  • Provide you with information by post, telephone, SMS or email about services we offer that we consider relevant to you.

When you request services, we ask that you provide accurate and necessary information that enables us to respond to your request. In doing so, you consent to our collection, use, storage and disclosure of this information to appropriate third parties for the purposes described in this Statement.

If you provide personal information about other individuals (such as employees, dependents, etc.), you must obtain their consent prior to your disclosure to PEMCAS.

  1. What information is being collected?

Personal Data is data you would recognise such as your name, date of birth and address but also any data from which you can be personally identified. We ask you to provide some Personal Data and we also automatically collect some of the Personal Data when you register on pemcas.ie and when you require our services. This list describes the types of data we can collect from you and process:

  • email address, phone number, mobile telephone number and IP address;

  • information you provide to us through correspondence, chats, dealing with any complaints, or shared by you from other social applications, services or websites.

The above list is not exhaustive but gives you a general picture. As technology develops more data may be collected automatically from your use of our sites. If we have to ask you to provide more Personal Data we will explain why when we ask for it. We may receive information about you from other sources. We work with third parties, (for example, payment services providers, credit agencies, sub-contractors in technical services and marketing companies) and may receive Personal Data from them about you.

Our site may contain links to other websites that are outside our control and are not covered by this Privacy Notice. If you access other websites using the links provided, the operators of these websites may collect information from you which will be used by them in accordance with their Privacy policy, which may differ from ours.

You can also send emails to us through the website or fill in a special form for a request: your messages will contain your screen name and email address, as well as any additional information you may wish to include in the message.

Information collected for newsletter subscriptions is collected with a special consent. Newsletter subscribers are given control over their subscriptions and can opt out or modify their details at any time. The sole purpose for which this information is collected is the distribution of PEMCAS newsletters and updates.

  1. How does PEMCAS use your personal information?

When you provide personal data to us, we use it for the purposes for which it was provided to us as stated at the point of collection (or as is obvious from the context of collection):

  • We store details of contractors and/or other people who provide services (not employees) to our company.

  • We store details of our previous customers or potential clients. We do marketing campaigns targeting various groups of people using market segmentation, mailing lists, SMS alerts, postal letters, social network websites etc.)

  • We process documents which have personal and/or business information. We may take hard copies or scanned images of various documents and keep them on record.

  • We store letters, emails, chats and other written or audio communication (where required).

  • We store details about our employees which relate to their job roles, skills and taxes.

We also process your personal data because it is necessary for our legitimate interests, or sometimes where it is necessary for the legitimate interests of another person.

In this respect, we use your personal data for the following:

  • Seeking advice on our rights and obligations, such as where we require our own legal advice.

  1. How does PEMCAS transfer and processing of your personal data outside the European Union?

The Personal Data that we collect from you may be transferred to, and stored at, a destination outside the European Union (“EU”) and European Economic Area (“EEA”). It may also be processed by staff operating outside the EU and EEA who work for us or for one of our suppliers. By submitting your information, you agree to this transfer, storing and or processing. We will take all steps reasonably necessary to ensure that your information is processed securely.

In these circumstances, your personal data will only be transferred on one of the following bases:

  • The country that we send the personal data to is approved by the European Commission as providing an adequate level of protection for personal data;

  • The transfer is to a recipient in the United States of America who has registered under the EU/US Privacy Shield;

  • The recipient has entered into European Commission standard contractual clauses with us; or

  • You have explicitly consented to the same.

  1. Data retention

The personal data you submit to us will only be retained for as long as is required for the purposes for which it was collected or as required by law.

For example, contact information about customers will be kept as long as the information is required to completely service the contact request or until a user requests that we delete that information. Discussion posts and email details are kept for only the period of time considered reasonable to facilitate the visitor’s requests.

The results of our services such as interpretations are stored in our database indefinitely and do not contain personal data of individuals.

  1. Does PEMCAS disclose your personal information?

We recognise that your information is valuable and we take all reasonable measures to protect your information while it is in our care.

We may share your Personal Data:

  • With organisations, we engage as agents or sub-contractors to perform functions on our behalf such as sending customer communications, analysing data, providing marketing assistance, processing payments and providing customer service. They will have access to Personal Data needed to perform their functions, but may not use it for other purposes;

  • To address security or technical issues and;

  • If we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation, or in order to enforce or apply our legal rights. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

We will not sell, trade or rent Personal Data to unaffiliated third parties except if we have obtained your express permission.

  1. Security

PEMCAS cares to ensure the security of personal data. When PEMCAS collects information about you, we also make sure that your information is protected from unauthorized access, loss, manipulation, falsification, destruction or unauthorized disclosure.

We employ strict physical, electronic and administrative security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage both on-line and off-line.

PEMCAS also provides training to all employees to help them understand their responsibilities when handling data to keep all data secure. We continually upgrade our systems and software to ensure safe and secure transfer and storage of all your electronic files. Confidentiality of materials is strictly enforced through non-disclosure agreements with employees and contractors.

  1. How can you access and update your information?

You have the right to request access to the information we have on you. You can do this by contacting us at admin@pemcas.ie.

We will make sure to provide you with a copy of the data we process about you. In order to comply with your request, we may ask you to verify your identity. We will fulfil your request by sending your copy electronically unless the request expressly specifies a different method.

If you believe that the information we have about you is incorrect, you are welcome to contact us so we can update it and keep your data accurate. You can also contact us at any time to withdraw the consent you provided us with a copy of your personal data processing.

If at any point you wish for PEMCAS to delete information about you, you can simply contact us.

Under the GDPR you have the following rights:

  • To obtain access to, and copies of, the personal data that we hold about you;

  • To require that we cease processing your personal data if the processing is causing you damage or distress;

  • To require us to erase your personal data;

  • To require us to restrict our data processing activities;

  • To receive from us the personal data we hold about you which you have provided to us, in a reasonable format specified by you, including for the purpose of you transmitting that personal data to another data controller; and

  • To require us to correct the personal data we hold about you if it is incorrect.
